1. Scope
1.1.
These General Terms and Conditions (hereinafter referred to as the "GTC") apply to all orders placed by consumers through the Gentle Glow online shop.

1.3.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.4.
The online shop is intended exclusively for customers with a delivery address in Austria. Deliveries are made exclusively within Austria.
1.5.
Any terms and conditions of the customer that deviate from these GTC shall not become part of the contract unless their validity has been expressly agreed to in writing.
2. Products Offered
2.1.
The online shop offers, in particular, the following products:
- T-shirts;
- Hoodies;
- CDs;
- USB flash drives containing MP3 files.
2.2.
The essential characteristics of the products are described in the respective product descriptions available in the online shop.
2.3.
Product images are provided for illustrative purposes only. Minor deviations, particularly in color, may occur due to different screen settings and shall not constitute a defect, provided that the product otherwise conforms to the agreed specifications.
2.4.
No personalized products or goods manufactured according to customer specifications are offered.
3. Conclusion of Contract
3.1.
The presentation of products in the online shop does not constitute a legally binding offer but merely an invitation for the customer to submit an order.
3.2.
Customers may select the desired products and place them in the shopping cart. Before submitting the order, customers may review and correct their entries.
3.3.
By clicking the final order button clearly indicating an obligation to pay, the customer submits a binding offer to conclude a purchase contract for the products contained in the shopping cart.
3.4.
After the order has been received, the customer will receive an automatic confirmation of receipt by email. This confirmation merely acknowledges receipt of the order unless it expressly states that the order has been accepted.
3.5.
The purchase contract is concluded when Gentle Glow expressly accepts the order by email, sends a PayPal payment request, or dispatches the ordered goods.
3.6.
Gentle Glow reserves the right to reject orders, particularly if a product is unavailable, payment cannot be successfully processed, or there are reasonable grounds to suspect misuse of the online shop.
3.7.
If an order is not accepted, any payments already made will be refunded immediately using the original payment method.
3.8.
The language available for the conclusion of the contract is German.
4. Prices and Shipping Costs
4.1.
The prices displayed in the online shop at the time the order is placed shall apply.
4.2.
All prices are stated in Euro and include the applicable statutory value-added tax (VAT), where VAT is applicable.
4.3.
Shipping costs may be charged in addition to the purchase price. The applicable shipping costs will be clearly displayed before the customer submits the order.
4.4.
The customer shall not incur any additional costs that were not disclosed before the order was placed.
5. Payment
5.1.
Payment shall be made exclusively via PayPal.
5.2.
The payment process is additionally governed by PayPal's own terms and conditions. PayPal is an independent payment service provider and is not affiliated with the seller.
5.3.
The purchase price, including any shipping costs, becomes due immediately upon conclusion of the contract.
5.4.
If payment cannot be successfully processed or if a completed payment is subsequently reversed, Gentle Glow is entitled to withhold delivery until full payment has been received.
5.5.
The customer's statutory rights remain unaffected.
6. Delivery
6.1.
Delivery is made exclusively to addresses within Austria.
6.2.
Products are generally shipped via Austrian Post (Österreichische Post).
6.3.
Unless otherwise stated for a particular product, the estimated delivery time is 10 to 14 days from the conclusion of the contract or, where advance payment has been agreed, from the successful receipt of payment.
6.4.
Where delivery periods are stated in "days," these refer to calendar days unless expressly indicated otherwise in the online shop.
6.5.
If the end of a delivery period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period shall end on the next business day.
6.6.
If a product is temporarily unavailable, the customer will be informed without undue delay. Where possible, the customer will also be informed of the expected new delivery date.
6.7.
If an ordered product is permanently unavailable, Gentle Glow may withdraw from the contract. Any payments already received will be refunded without undue delay.
6.8.
Partial deliveries are permitted where reasonable for the customer. Partial deliveries arranged by Gentle Glow shall not result in any additional shipping costs for the customer.
7. Retention of Title
The delivered goods shall remain the property of Gentle Glow until the purchase price and all costs associated with the order have been paid in full.
8. Statutory Right of Withdrawal
8.1.
Consumers generally have the right to withdraw from distance contracts within 14 days without giving any reason.
8.2.
Details regarding the right of withdrawal, the consequences of withdrawal, and the return procedure are set out in the separate Withdrawal Policy, which forms an integral part of these GTC.
8.3.
The customer shall bear the direct costs of returning the goods.
8.4.
Gentle Glow shall not charge any additional handling or restocking fees for returned goods.
9. Exception to the Right of Withdrawal for Sealed Media
9.1.
The right of withdrawal does not apply to contracts for the supply of sealed audio recordings, sealed video recordings, or sealed computer software if the seal has been removed after delivery.
9.2.
This exception may apply in particular to sealed CDs and sealed USB flash drives containing MP3 files.
9.3.
The right of withdrawal expires only if the relevant storage medium was actually delivered in sealed packaging and the customer has removed or damaged that seal after delivery.
9.4.
As long as the seal remains intact, the statutory right of withdrawal continues to apply.
9.5.
The customer's statutory warranty rights in relation to defective or non-conforming goods remain unaffected by this exception.
10. Inspection of Goods and Diminution in Value
10.1.
During the withdrawal period, the customer may inspect the goods only to the extent that would be possible in a physical retail store.
10.2.
The customer shall only be liable for any diminished value of the goods if such loss in value results from handling that was not necessary to establish the nature, characteristics, and functioning of the goods.
10.3.
Simply opening normal shipping packaging does not automatically result in liability for diminished value.
10.4.
In the case of clothing, the customer may, in particular, inspect the size, fit, and quality of the product. Any use beyond a normal fitting, including excessive wear, soiling, damage, or washing, may result in liability for diminished value.
10.5.
The provisions regarding sealed CDs and sealed USB flash drives set out in Section 9 remain unaffected.
11. Warranty
11.1.
The statutory warranty provisions shall apply, in particular the Austrian Consumer Warranty Act (Verbrauchergewährleistungsgesetz – VGG) and the applicable provisions of the Austrian Civil Code (Allgemeines Bürgerliches Gesetzbuch – ABGB).
11.2.
Gentle Glow warrants that the goods possess the contractually agreed characteristics as well as the objectively required characteristics at the time of delivery.
11.3.
For new movable goods, the statutory warranty period is generally two years from the date the goods are delivered.
11.4.
If a defect exists, the customer shall be entitled to the statutory warranty remedies, including, where the legal requirements are met, repair, replacement, price reduction, or termination of the contract.
11.5.
Customers are requested to report any apparent transport damage as soon as possible by email to

A voluntary guarantee shall only apply if it is expressly designated as such for the respective product and described in separate guarantee terms.
12. Liability
12.1.
Gentle Glow shall be liable in accordance with statutory provisions for damages caused intentionally or through gross negligence.
12.2.
In the event of personal injury or where liability is mandatory under applicable law, the statutory provisions shall apply without limitation.
12.3.
In cases of slight negligence, Gentle Glow shall, to the extent permitted by law, be liable only for the breach of essential contractual obligations and only for damage that was typically foreseeable at the time the contract was concluded.
12.4.
Mandatory statutory claims, particularly those arising under the Austrian Product Liability Act (Produkthaftungsgesetz), the Austrian Consumer Protection Act (Konsumentenschutzgesetz), and the Consumer Warranty Act (Verbrauchergewährleistungsgesetz), shall remain unaffected.
12.5.
Gentle Glow shall not be liable for disruptions or limitations that are solely attributable to the customer, the customer's internet service provider, PayPal, or other independent third parties, unless such disruptions were caused by Gentle Glow's own fault.
13. USB Flash Drives and Compatibility
13.1.
USB flash drives containing MP3 files are physical goods with pre-stored audio files.
13.2.
The technical requirements and supported file formats required for use are specified in the respective product description.
13.3.
Before placing an order, the customer is responsible for ensuring that their device has a suitable USB port or compatible adapter and supports the specified file format.
13.4.
The customer's statutory warranty rights regarding defective USB flash drives, damaged files, or deviations from the product description shall remain unaffected.
14. Copyright and Rights of Use
14.1.
The music recordings and all other content stored on CDs and USB flash drives are protected by copyright.
14.2.
By purchasing the product, the customer acquires the right to use the purchased content for private purposes to the extent permitted by law.
14.3.
Commercial use, public performance, public communication, distribution, reproduction, or modification of the content is permitted only where authorized by law or with the permission of the respective copyright holder.
14.4.
Mandatory statutory exceptions and limitations under copyright law shall remain unaffected.
15. Data Protection
15.1.
Personal data shall be processed exclusively in accordance with the applicable data protection legislation.
15.2.
Further information regarding the type, scope, purpose, legal basis of data processing, and the rights of data subjects is provided in the separate Privacy Policy of the online shop.
15.3.
To the extent necessary for payment processing, the required data will be transmitted to PayPal. Data required for delivery will be transferred to Austrian Post (Österreichische Post) or other shipping service providers engaged for delivery.

16.2.
Gentle Glow will make reasonable efforts to process complaints within an appropriate period of time and to find an amicable solution together with the customer.
17. Governing Law
17.1.
These GTC shall be governed by the laws of Austria, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
17.2.
This choice of law shall not deprive consumers of the protection afforded by mandatory consumer protection provisions that would apply in the absence of such choice of law.
17.3.
The statutory rules on jurisdiction applicable to consumers shall apply. No agreement on a different place of jurisdiction has been made.
18. Final Provisions
18.1.
Amendments or supplements to the contract shall not be subject to any stricter formal requirements than those prescribed by applicable law.
18.2.
Should any provision of these GTC be or become wholly or partly invalid or unenforceable, the remaining provisions shall remain unaffected.
18.3.
Any invalid or unenforceable provision shall be replaced by the applicable statutory provisions.

Withdrawal Policy
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day:
- on which you, or a third party designated by you (other than the carrier), take possession of the goods; or
- in the case of a single order for multiple goods delivered separately, on which you, or a third party designated by you, take possession of the last item; or
- in the case of goods delivered in several partial shipments or pieces, on which you, or a third party designated by you, take possession of the last partial shipment or the last piece.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post or an email).

You may use the model withdrawal form provided below, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery offered by us.
Any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us will not be reimbursed.
The reimbursement will be made without undue delay and, in any event, no later than 14 days from the day on which we receive your notice of withdrawal.
We will use the same means of payment for the reimbursement as you used for the original transaction, unless expressly agreed otherwise with you. You will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have returned the goods, whichever occurs first.

The deadline is met if you dispatch the goods before the expiry of the 14-day period.
You are responsible for the direct cost of returning the goods.
